These terms and conditions apply to all bookings whether made via our website, by email or over the telephone. They contain important information and we kindly ask that you read these carefully. If there is anything you would like to discuss regarding your booking or these terms and conditions, please don’t hesitate to contact us.

WHO WE ARE

The Spa at Breedon Priory Ltd is a standalone facility based in the village of Wilson, Nr Melbourne, Derbyshire. Our registered office is at Charnwood Accountants, The Point, Granite Way, Mountsorrel, Nr Loughborough, Leicestershire LE12 7TZ, company number 13332232.

YOUR BOOKING REQUEST

Your booking will not be complete until you receive a confirmation from us, at which point a contract will come into existence between you and us.

PROMOTIONAL OFFERS

Payments for promotional offers must be paid in full at time of booking. These payments are non-refundable and non-transferable.

RESERVATIONS AND CANCELLATIONS

All spa reservations require full payment upon booking and are non-refundable. Should you have a medical condition we request that you seek advice from your GP whether you are suitable to use our facilities/treatments prior to booking. To maintain the ambience, you would expect from a spa, we limit group bookings to a maximum of six people per group. Please provide us with at least 7 days’ notice if you are unable to make your appointment/spa package and we will be happy to re-schedule with an admin fee of £10 per person. We reserve the right to alter treatment times on the day if necessary. All treatment times include consultation and aftercare.

If you wish to make a change to your booking, please contact us. We will let you know if the change is possible and will send you a confirmation email with the new booking details if the change has been accepted and the admin fee has been paid.

We will do our best to avoid having to cancel your booking however, where necessary, we reserve the right to cancel your booking at any time. In such circumstances, we will provide you with a full refund and we will have no further liability to you in relation to the cancellation. We recommend that you are covered by a travel insurance policy in the event of adverse weather, bereavement, illness or other that would prevent you from attending your spa experience as planned.

COVID-19

The Spa at Breedon Priory has taken great care to comply with the guidelines and regulations set out by the Government to combat the spread of the coronavirus and to protect the health and wellbeing of our guests and team members to the best of our ability. However, due to the very nature of the virus as a highly contagious disease, the spa cannot be held accountable should any customers contract the disease as guests may be exposed to persons and situations unknown to us, which are out of our control, and therefore cannot pursue any claims against the company relating to coronavirus. Guests are respectfully requested to comply with the Covid-19 measures for the safety

and wellbeing of themselves, other guests and team members and failure to do so will be taken very seriously and may result in guests being requested to leave the premises.

Covid-19 – the current coronavirus pandemic and subsequent government restrictions are out of the control of both The Spa at Breedon Priory and our guests. Where government guidelines force the full or partial closure of our spa or restaurant then any bookings will become fully transferrable to a future date and supersede the specific booking terms and conditions of any individual reservation.

Should the future date carry higher charges for products or services then the additional amounts will need to be paid as part of the normal process. For example, should a midweek booking be cancelled and then re-booked at a weekend, then additional charges will apply.

Bookings that have been subject to an initial postponement and rebooking as a result of a Government decision and are then subject to a second postponement and which rebooking becomes impossible, we will be prepared to enter into negotiations on the contracted cancellation policy within reasonable limits and depending on the specific circumstances of each individual booking/event.

CHARGES

The price of your visit (which includes VAT) will be the price indicated when you make your booking via the website, or as communicated to you if you place your booking by telephone or email. We will confirm the price of your visit in our confirmation email, so please double-check when you receive it and let us know if you notice any abnormalities. Where there has been an obvious discrepancy between our published charges and the price stated on our website or otherwise communicated to you, we reserve the right to charge our correct charges or to cancel your booking.

The Spa at Breedon Priory reserves the right to ask guests to provide a valid credit or debit card upon check-in. A credit card pre-authorisation may be taken upon arrival for the amount of £1.00 which will then be deducted on check-out.

All charges incurred during your visit, for example food and beverage/retail/treatment charges which you have not paid for in advance, must be settled upon check-out, when you will have the option to provide a different method of payment should you wish. Please let us know before you check-out if you notice any abnormalities in any charges which have been assigned to you as these cannot be rectified after departure.

SPA DAYS: GENERAL DETAILS, PAYMENT & CANCELLATION

Treatment times are scheduled during your booking. You will receive an itinerary upon arrival which will state your treatment and Terrace Restaurant times. If you have made any treatment requests, we will endeavour to meet these but unfortunately, we cannot always guarantee these will be met.

Full pre-payment of the package value is required at time of booking either online or via our reservationist to make a confirmed booking. Payment can be made via debit or credit card.

Unless explicitly stated all prices are inclusive of VAT at the prevailing rate and won’t be adjusted should this rate be amended.

Any cancellation requests must be made in writing.

A charge of £25 per person per half hour will be charged if you do not check out at your allocated time.

All bookings made will be subject to our standard terms and conditions as shown below:

The Company will apply the following charges per person for cancellation/amendment:

  1. Alterations to bookings (must give 7 days’ notice): £10 administration fee per person.
  2. Non arrivals for any bookings will be non-refundable or transferable.

iii. Cancellations are non-refundable after 24hours of making the booking.

No refund will be given for late check in or early departure.

The lead booker is responsible for the entire reservation, including the settling of all charges prior, during and after visit and for the compliance of all guests with their etiquette.

The Company will require a pre-authorisation of a credit or debit card on arrival, this will need to be a physical card and entry of your pin number will be required. Contactless payments are not accepted as a pre-authorisation.

We reserve the right at all times to cancel any reservation without notice or reason.

Should we be advised by the Government or relevant licensing authority that we are not able to operate as normal for any reason, we will make every effort to contact you ahead of your arrival and should you wish your reservation can be amended without penalty regardless of our standard cancellation terms and conditions.

Treatments (general)

We cannot guarantee that all treatments will be available at all times & treatment durations are provided as a guide only.

  1. It is the individual’s responsibility to ensure the treatment is suitable for them.
  2. No refund is available for treatments that are missed or shortened as a result of late arrival by the guest.

iii. We reserve the right at all times to cancel any reservation without notice or reason.

  1. Unless a request is made at least a week in advance, all treatments take place in rooms on the first floor and involve climbing a set of stairs. We will endeavour to assist you should you be disabled or have mobility problems by allocating our ground floor treatment room for your treatment; but it is your responsibility to make enquiries around availability of this area for your treatment at least a week in advance. We cannot be held responsible if we are unable to carry out your treatment if advance notice is not given.

Medical

Guests are advised to consult with their doctor about the need to avoid any treatments or facilities.

It is important that you disclose any medical/mobility condition at the time of booking.

Certain medical conditions may preclude you from spa treatments or facilities available.

Refunds will not be given if you fail to reveal a condition relating to the above.

Please be advised that our treatment rooms are all sited on the first floor and involve climbing stairs.

The Spa at Breedon Priory Gift Vouchers

The Spa at Breedon Priory policy is that vouchers are valid for 6 months from date of purchase unless otherwise stated. The expiry date is published on the voucher.

We endeavour to process and send all gift vouchers orders within 48-hours of the purchase being made. Please note that in some instances, such as Christmas and Bank Holidays, there may be a delay to the processing of orders

Any voucher ordered with postal delivery will be sent via First Class post with Royal Mail. We cannot accept responsibility for the length of delivery time or the non-delivery of orders once the goods are dispatched and delivery times are wholly reliant on Royal Mail.

Gift vouchers are non-refundable and cannot be exchanged for cash.

Cash change for unused voucher amounts will not be given however if there is a remaining balance on your voucher, you can retain the voucher number and redeem the amount at a later date, providing the voucher is still in date.

If you are unable to use your voucher before the expiry date, please contact us before the voucher expires to discuss a possible extension.

We may charge a small fee to extend vouchers in extenuating circumstances, to cover any increased operational costs over the additional validity period.

To ensure we do not breach VAT deferral rules, a gift voucher cannot be used to purchase other gift vouchers.

The voucher number and expiry date are required when making a booking with our reservations team.

Please ensure you present your redeemable voucher on arrival. If you forget your voucher, or your voucher is not valid, then we will require full payment via an alternative payment method, in order to continue your visit.

Please contact us to check availability as soon as you are able, as all voucher redemptions are subject to availability.

Important Information

Any mechanical or electrical breakdowns on the property are usually beyond our control.

No refunds will be given unless any such breakdown is due to the negligence of the Company.

Any damages or spillages caused maybe subject to a charge.

No responsibility can be accepted by the Company for the safety of money or valuables.

The Company is not liable for valuables unless it is solely due to negligence of the Company.

The minimum age of guests wishing to make use of our facilities is 18 (eighteen) years old.

We do not allow guests to bring pets (except guide dogs).

Smoking is not permitted in any of the buildings or grounds.

No alcohol is to be brought onto the premises – we reserve the right to confiscate alcohol found and return it on departure.

We will use your contact information for our own marketing purposes only if consent is given to do so. We will never share with third parties and you are able to unsubscribe at any time.

SERVICE CHARGE

The optional service charge is a payment which recognises and rewards all employees who deliver outstanding guest service. The optional service charge is 2.5%. If you do not wish to pay it, you can ask for it to be removed from your bill. The service charge is shared amongst all members of the Spa team. We believe the whole team, regardless of their role, are involved in delivering outstanding guest service so it is fair to reward everyone.

No Smoking: No smoking is permitted anywhere within the premises of The Spa or its grounds. We reserve the right to terminate the remainder of your visit in the event that we find you have failed to comply with our no smoking policy.

Animals & Pets: No animals are allowed

Accidents: Guests must report any accident or injury they or their guests may have whilst on the premises immediately to a member of management and in any event, within 24 hours of the incident. This information is needed in order to comply with health and safety obligations and for insurance purposes.

Inappropriate Behaviour: we kindly ask that you respect other guests and our employees and refrain from any improper, violent, or abusive behaviour and any illegal conduct at all times during your visit. We reserve the right to eject you from the premises and cancel the remainder of your visit in the event that you fail to respect this policy.

Damage: We kindly ask that all guests respect The Spa and facilities. In the event that there is any damage caused by you, we reserve the right to charge the card you have used to secure your booking a reasonable fee in respect of such damage and/or missing items.

Parking: We are unable to take responsibility for your car or any belongings that are in your car whilst you are onsite. Please make sure that all valuables are removed from your car.

Press: We have a strict no press policy. Guests will be held accountable if they disclose or identify any other members or guests who are in The Spa in any press or social media including Facebook, Twitter, Instagram and on personal blogs. Similarly, guests must refrain from identifying or describing any private hire or member event occurring at The Spa at Breedon Priory.

USING THE SPA FACILITIES

Use of any of the facilities available at The Spa at Breedon Priory is entirely at your own risk.

When using any facilities, you must take care to safeguard your own health and safety and that of other people, and you will be solely responsible for any loss or injury that you cause to yourself, other persons or to the facilities to the extent that it is caused through your unsafe or improper use of the equipment or facilities (including your use of them whilst under the influence of alcohol or medication) or your failure to advise staff of a medical condition relevant to your use of the equipment or facilities.

DAMAGE & LOSS

We advise that you bring no personal belongings or valuables with you on your visit to the spa. We provide a personal locker for the storage of your small items and all reasonable efforts are made to provide a secure environment. Nevertheless, the risk of theft, damage or loss of our guests’ personal possessions cannot be eliminated entirely, and we strongly advise you against bringing valuable items such as jewellery or large amounts of cash.

We shall not be liable to any guest for any loss, damage or injury suffered by our guests or to their property. However, this does not exclude or limit in any way our liability where it would be unlawful to do so, and which includes liability for death or personal injury caused by our negligence (or the negligence of our employees, agents, or subcontractors) and for fraud or fraudulent misrepresentation.

THE SPA AT BREEDON PRIORY TRADEMARKS

All guests shall not use the names, logos, colours, trademarks, service marks, photographs, trade dress, or other identifying features of The Spa at Breedon Priory without obtaining our specific prior written approval as to the specific use.

Guests expressly recognise that The Spa at Breedon Priory Marks are the valid, unique, and exclusive property of, its parent, affiliates and/or subsidiaries. Guests may not produce or create or authorise others to produce or create The Spa at Breedon Priory Marks for any purpose whatsoever, including, but not limited to, in any communications, marketing, advertising or other promotional materials (including, but not limited to, brochures, flyers, invitations, e-mail messages, etc.) that utilise The Spa at Breedon Priory Marks without our prior written consent.

EVENTS

Each event will have their own specific terms and conditions regarding booking, payment, and cancellation.

Any special dietary requirements must be advised to the spa a minimum of 7 days prior to the event otherwise the spa cannot guarantee to fulfil the request although all efforts will be made to do so. Ticketed events will go ahead based on minimum booking levels being achieved. The spa reserves the right to amend, postpone or cancel any advertised events with a minimum of 7 days’ notice to guests already booked.

The Spa at Breedon Priory reserves the right to make alterations to the content of any ticketed events including, but not limited to, menus, drinks, entertainment etc to reflect any last-minute issues with suppliers, ingredients, or any other unforeseen circumstances. Any substitutes will be of an equal quality to elements originally advertised. During the current Covid-19 pandemic all events will be organised to reflect the latest government guidelines which may mean last minute changes to table sizes and running orders as required.

COMPETITIONS

Subject to availability. Entrants must be aged 18 or older. Prize may usually be for one winner plus their guest and may include either a half or full day in the spa, or a

retail voucher to be spent at the spa. No cash or other alternative to the stated prize is available, except in the event of unforeseen circumstances, the stated prize is no longer available, the Promoter reserves the right to provide a similar prize or a prize of equal or greater value. The prize does not include travel. The prize must be redeemed by the date stated and is subject to availability at time of booking.

OTHER IMPORTANT TERMS

Force Majeure: The Spa at Breedon Priory will not be responsible and will not pay any compensation where we are prevented or delayed from performing our obligations due to an event beyond our reasonable control, including but not limited to flood, earthquake, mechanical breakdown, IT failure, fire, adverse weather conditions, acts of terrorism, gas, water, or other utilities.

We may transfer this agreement to someone else: We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.

If a court finds part of this contract illegal, the rest will continue in force: Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

Even if we delay in enforcing this contract, we can still enforce it later: If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you, but we continue to provide the products, we can still require you to make the payment at a later date.

Governing Law & Disputes: These terms are governed by English law and you can bring legal proceedings in relation to these terms or your visit at The Spa at Breedon Priory in the English

courts. If you live in another country in Europe, consumer law and regulation may mean that you can bring legal proceedings the country within Europe in which you reside.

Alternative Dispute Resolution: Alternative dispute resolution is a process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court. If you are not happy with how we have handled any complaint, you may want to contact the alternative dispute resolution provider we use.
